Terms of Service

1. Acceptance of Terms

By accessing or using Crave List ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Crave List is a web application that allows users to track, organize, and manage lists of restaurants, places, and locations they want to visit or have visited. The Service integrates with Google Places API to provide location information and uses Google OAuth for authentication.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by signing in with Google OAuth. By creating an account, you represent that:

  • You are at least 13 years of age
  • All information you provide is accurate and current
  • You will maintain the security of your account credentials
  • You will promptly update any information to keep it accurate

3.2 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be inappropriate or harmful.

4. User Content

4.1 Your Content

You retain ownership of all content you submit to the Service, including restaurant entries, place entries, location entries, notes, tags, and photos ("User Content"). By submitting User Content, you grant us a license to store, display, and process your content solely for the purpose of providing the Service to you.

4.2 Content Restrictions

You agree not to submit User Content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
  • Contains software viruses or any other malicious code
  • Impersonates any person or entity or misrepresents your affiliation with any person or entity
  • Violates the privacy or publicity rights of others

4.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse, support, represent, or guarantee the completeness, truthfulness, or accuracy of any User Content.

5. Third-Party Content and Services

5.1 Google Places Data

Location information, including place names, addresses, photos, ratings, and hours, is provided by Google Places API. This information is subject to Google's Terms of Service and may contain errors or be outdated. We are not responsible for the accuracy of third-party data.

Google Maps and Google Places content is used in accordance with Google's Terms of Service.

5.2 Third-Party Links

The Service may contain links to third-party websites or services (such as restaurant websites). We are not responsible for the content, privacy policies, or practices of any third-party sites or services.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service or related systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use any automated system (bots, scrapers, etc.) to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove, circumvent, or disable any security or technological features of the Service
  • Use the Service in any manner that could damage, disable, overburden, or impair our servers

7. Intellectual Property

7.1 Service Ownership

The Service, including its design, features, graphics, and code, is owned by Crave List and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

7.2 User Content License

While you retain ownership of your User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, store, and display your content solely for the purpose of operating and improving the Service.

7.3 Attribution

Data from Google Places API must be attributed to Google as per their requirements. Photos and content from Google may be subject to additional licensing terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

9. Disclaimers

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Availability

We do not guarantee that the Service will be available at all times or that it will be error-free. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

9.3 Accuracy of Information

Location information from Google Places API may be inaccurate, incomplete, or outdated. We are not responsible for verifying the accuracy of place information, hours of operation, or other third-party data. Always verify critical information (such as restaurant hours) before visiting.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAVE LIST AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE PAST SIX MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Crave List and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Crave List operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property infringement.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crave List regarding the Service and supersede all prior agreements and understandings.
